NYS Department of Labor Workplace Violence Prevention for NY State Public Employers
The NYS Department of Labor Public Employee Safety and Health Bureau (PESH) requires public sector employers in New York State to institute workplace violence prevention programs. These programs must include Employer/employee collaboration, Risk hazard assessment, Implementation of controls, Records review, walk-around, Written policy statement, Written program, Training, Recordkeeping and reporting, and Periodic review (at least annually). Penal Law Part 3 Title H Section 120.05 Assault in the Second Degree. Enacted on November 2, 2010, The Violence Against Nurses law offers nurses the same protection as police officers, firefighters, and emergency medical technicians. Patients who physically attack nurses could serve seven years in prison.
